Montgomery County Bench Warrants Explained
A bench warrant or similar capias can follow a missed court appearance or failure to meet an order in an existing case. Montgomery County court materials use several terms, including warrant, FTA, VPTA, and capias pro fine. The case stage and issuing court control which term applies.
Conroe's Municipal Court says a citation may become a warrant after a missed due date or failure to comply with an agreement. Oak Ridge North labels a missed initial appearance “AW” and a later failure to comply with a court order “CP.” Those city labels are not a countywide code.
Montgomery County JP Bench Warrants Follow the Citation Court
For a JP case, use the precinct printed on the citation. The five precinct courts handle traffic and Class C matters and keep their own case records. The addresses and phones below are distinct routes, not one central warrant counter.
| Court | Published contact route | Case help |
|---|---|---|
| JP1, Willis | 300 S. Danville, 936-539-7801 | Traffic/Class C and JP process |
| JP1, Montgomery | 19380 Hwy 105 W, Suite 507, 936-788-8374 | Same precinct, alternate location |
| JP2 | 2241 N. 1st, Conroe, 936-538-3788 | Traffic/Class C and JP process |
| JP3 | 1520 Lake Front Circle, Suite 100, The Woodlands; 281-364-4284 or 936-539-7803 listed | Verify the current number |
| JP4 / JP5 | New Caney: 281-577-8970; Magnolia: 936-539-7806 | Payment, forms, or time-served route |
Use the official precinct page to confirm hours and the correct counter before traveling. A sheriff search can be a secondary lead, but it does not offer a lower-court filter.
How Montgomery County Bench Warrants Are Issued
The judge or authorized court issues process after the case record shows an unmet court obligation. A missed setting can lead to an FTA or VPTA entry and a warrant, but the exact notice and steps vary by court. A capias pro fine is a post-judgment tool and should not be treated as the same event as an initial missed appearance.
After issuance, the court file, public sheriff search, service agency, and any OmniBase report may update on different schedules. Texas has no single public statewide warrant roster. Check with the issuing court for the current order and with the court about the separate compliance status.
Montgomery County Bench Warrant Labels Differ by Court
Oak Ridge North's published decision tree is a useful local example, but it applies to that city's Municipal Court. AW means Arrest Warrant Status after failure to appear by the initial appearance date. CP means Capias Pro Fine after a plea, judgment, or payment arrangement is not followed. The city says an FTA/VPTA and additional fines or fees may accompany AW status.
| AW | Missed initial appearance; ask about a new date, payment, or agreement. |
|---|---|
| CP | Failure to comply with a court order after plea or judgment; ask whether a hearing is available. |
| OmniBase | Oak Ridge North says warrant-status cases are forwarded for FTA reporting; confirm the individual case. |
Do not carry these abbreviations, the city's 50% down plan term, or its collection details over to another court. Use the wording printed on the actual case.
Bench Warrants and Arrest Warrants Compared
A bench warrant is commonly tied to a missed appearance or court directive in an existing case. An arrest warrant begins with a complaint and probable-cause review. Either may direct a peace officer to take a person into custody, but the trigger, underlying case, and court process differ. A warrant is not a conviction. The arrest warrant page explains the separate Chapter 15 procedure.
| Feature | Bench Warrant | Arrest Warrant |
|---|---|---|
| Trigger | Missed setting or unfulfilled court obligation | Complaint and probable-cause review |
| Who issues | Judge or court handling the case | Magistrate with authority |
| Underlying case | Existing docket or citation | Charged offense |
| Next step | Ask the issuing court about setting or recall | Confirm status and discuss bond or appearance with counsel |
Montgomery County Bench Warrants Follow City-Specific Rules
Conroe links a court search and a contact-a-warrant-officer form. Willis lists a Warrants and Compliance function, but no public roster was located. Magnolia describes safe-harbor help and a two-week update cadence. Shenandoah directs citations before September 1, 2011 to JP3. These are different local routes, not one countywide bench-warrant policy.
Oak Ridge North publishes an AW/CP decision path and a city-specific payment-plan term. Confirm the exact court and label before assuming a new date, fee, or hearing option exists.
Resolving a Montgomery County Bench Warrant
Call the named court with the case or citation number and the date of the missed setting. Ask if a new appearance, payment agreement, hearing, or attorney request is available. Ask whether the court requires identification, a bond, or a deposit, and how it reports compliance to OmniBase. If the matter went to collection, request the full current ledger before paying.
- Confirm the issuing court, case number, and active status.
- Ask counsel whether to request recall, quash, or a planned appearance.
- Follow the court's approved setting, payment, hearing, or bond instructions.
- Get written proof of the new date or recall and confirm any state hold separately.
Caution: A phone call alone may not count as an appearance; confirm the court's required step and keep written proof.
Montgomery County JP Warrant Payments Need Posting Time
JP4 publishes a payment-plan request route and warns that online payments may take about two to four days to post. A receipt confirms a transaction, not necessarily that the court has already recalled a warrant. Ask the JP clerk when the docket and any OmniBase report are expected to update.
JP5 separately posts forms, fees, payment-plan materials, and a time-served request. Those options belong to the issuing court and do not establish a countywide plan or indigency rule.
The JP4 payment-plan page describes its route and methods.

Do not assume a payment plan or a balance update clears a separate city or county-court warrant.
Finding the Court That Issued the Warrant
A bench warrant stays with the court that set the missed date or entered the order. The Sheriff may serve it, but the court controls the docket, recall, and new appearance. Read the caption on the citation, summons, or case paper. If you do not have it, ask MCSO Records or the clerk which court holds the case.
District felony matters go to the District Clerk; county misdemeanor cases go to the County Clerk; a JP or municipal citation goes to its own court. The Montgomery County warrant lookup is one lead and does not replace the issuer's record.
Montgomery County Bench Warrant Caller Checklist
Have the case or citation number, the name used on the case, the missed date, and any notice or post-warrant card. Ask whether a new date is possible, whether counsel may appear, whether a bond or deposit is required, and what identification the clerk needs.
Ask if a payment plan, hearing, indigency review, community service, or other statutory alternative applies to that case. Confirm whether a payment, appearance, or order has been reported to OmniBase and when the court will show the change. Magnolia's court states that a phone call does not constitute appearance; do not assume a call or voicemail changes another court's deadline.
Save the outcome: Request the next date or recall confirmation in writing and retain each payment receipt.
